2.       A second subpoena, attempted to serve Father through the Shelby County Sheriff’s Office, was also returned after several attempts, all unsuccessful.

3.        Mother's Affidavit of Diligent Search itemizes multiple attempts through various sources to locate Father, all unsuccessful.

4.      The return of service of the private process server indicates Father's automobile in the driveway on several occasions, but he never came to the door or responded to the process server's requests to contact him.

5.        Father had proper notice of Mother's Motion, set on Wednesday, February 7, 2024.

6.       As such, good cause exists to grant Mother's Motion and issue service of her Petition to Modify Parenting Schedule through Publication, as Father is intentionally evading service.

All Sealed Bids, Bidder’s Qualifications, and Bid Envelope, in duplicate, will be received from Bidders on Tuesday, March 12, 2024, at the Contracts Management Office, Memphis Light, Gas and Water Division (“MLGW” or “Division”), Room 323, 220 South Main Street, Memphis, Tennessee (mailing address: P.O. Box 430, Memphis, Tennessee 38101-0430), before 4:00 PM CDT/CST. If you bring your bid to MLGW, please allow 30 minutes before 4:00 PM CDT/CST for MLGW security clearance and delivery of bids to the Contracts Management Department. The project scope is to purchase the Cisco Security Suite Enterprise Agreement (EA) 3.0 Bundle, including a five (5) year support agreement. The security suite enterprise agreement is to reduce the cost of renewing individual license subscriptions and add new network security features needed to support MLGW. This agreement also will allow an additional 10-15% room for growth at no additional cost to the Division. The purchase must meet the required software, and services in strict accordance as outlined in the Contract Documents and Specifications.

All bidders are required to be authorized Cisco Partner Certified resellers for the software components that they are proposing to furnish. MLGW’s understanding is that the partner must hold the Cisco Advanced Security Architecture Specialization (ASAS) and Cisco Master Security Specialization. No subcontract or third-party bids will be accepted.

LICENSING DISCLOSURE REQUIREMENTS:

The prime bidder must be licensed to do business in the State of Tennessee.

All bidders must be licensed contractors as required by Title 62, Chapter 6, of the Tennessee Code Annotated and must comply with the requirements of Tenn. Code Ann. 62-6-119.

In addition, the Sports Authority requires that the bidder’s license number, license expiration date, and that part of the license classification that applies to the bid, appear on the outside of the envelope containing the bid. The bidder shall also include, on the outside of the bid envelope, the name, license number, license expiration date, and license classification of any subcontractor to be used by the bidder for electrical, plumbing, heating, ventilation & air conditioning work, and masonry provided that such classifications (i.e. electrical, plumbing, heating ventilation & air conditioning and masonry) are applicable to the project. In the event that such classifications are not applicable to the project, the bidder shall indicate same on the outside of the bid envelope, by designating the classification and the words “not applicable” or “NA”.

The above licensing disclosure requirements shall not apply to any bid that is less than $25,000. If any bid amount, whether for the total bid submitted by the bidder as general contractor or for a sub-bid for electrical, plumbing, and/or heating ventilation & air conditioning work, is less than $25,000, or if the masonry bid amount is less than $100,000, the licensing disclosure requirements set out above are not applicable. In lieu thereof the bidder must provide on the outside of the bid envelope, his name and address and/or the name and address of any such subcontractor whose sub-bid is less than $25,000 ($100,000 for masonry), along with the words "exempt from licensing requirement."

PROJECT DESCRIPTION / PURPOSE

The applicant proposes dredging of approximately 55,000 cubic yards of sediment from an area of approximately 8.52 acres in McKellar Lake to a water depth of approximately 10.4 feet to provide barge access to the North and South Loading Docks. Installation of a 48-inch diameter barge dolphin will also be conducted. Dredged materials will be transported via hydraulic pipeline or barge to the Corps of Engineers disposal site on Treasure Island or the Memphis and Shelby County Port Commission disposal site at the mouth of McKellar Lake.

ANTIDEGRADATION

In accordance with the Tennessee Antidegradation Statement (Rule 0400-40-03-.06), the Division has made the preliminary determination that the proposed activities will not result in an appreciable permanent loss of resource values, and therefore will result in no more than de minimis degradation of a waters without mitigation.

For more information, please reference Tennessee’s Antidegradation Statement which is found in Chapter 0400-40-03 of the Rules of the Tennessee Department of Environment and Conservation.

FACTORS CONSIDERED

In deciding whether to issue or deny this permit, the Division will consider all comments of record and the requirements of applicable federal and state laws. The division will consider the nature, scale and effects of proposed impacts. The Division will consider practicable alternatives to the alteration, loss of waters or habitat, diminishment in biological diversity, cumulative or secondary impacts to the water resource, and adverse impacts to unique, high quality, or impaired waters.

HOW TO COMMENT

TDEC is requesting public comment on this proposed permit action. Obtaining a broad range of facts and opinions on Agency actions is one of the best ways to ensure appropriate decisions. Persons wishing to comment on the proposal are invited to submit written comments to the Division. Written comments must be received within thirty days following distribution of the approved public notice materials (including signage and newspaper ad). Comments will become part of the record and will be considered in the final decision. The applicant’s name and permit number should be referenced. INITIAL RESOLUTION AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION BONDS BY THE CITY OF MILLINGTON, TENNESSEE IN A PAR AMOUNT NOT TO EXCEED $33,023,000 TO PAY FOR THE CONSTRUCTION, RENOVATION AND EXPANSION OF SCHOOL BUILDINGS AND FACILITIES AND RELATED COSTS AND TO PAY THE COSTS INCIDENT TO THE SALE AND ISSUANCE OF THE BONDS

 BE IT RESOLVED by the Board of Mayor and Aldermen of the City of Millington, Tennessee (the “Municipality”) that for the purpose of financing the construction, renovation and expansion of school buildings and facilities and related costs and to pay the costs incident to the sale and issuance of the bonds, the Municipality shall issue bonds in a par amount not to exceed $33,023,000, which shall bear interest at a rate or rates not to exceed the maximum rate permitted by Tennessee law, and which shall be payable from ad valorem taxes to be levied on all taxable property within the corporate limits of the Municipality. Such bonds shall be additionally payable from any funds received from the Millington Municipal Schools Board of Education for payment of debt service on such bonds.

 BE IT FURTHER RESOLVED by the Board of Mayor and Aldermen that the City Clerk is hereby directed to cause this initial resolution to be published once in full in a newspaper having a general circulation in the Municipality, together with the following statutory notice:

NOTICE

The foregoing resolution has been adopted. Unless within twenty (20) days from the date of publication hereof a petition signed by at least ten percent (10%) of the registered voters of the Municipality shall have been filed with the City Clerk protesting the issuance of the bonds, such bonds may be issued as proposed.

 BE IT FURTHER RESOLVED by the Board of Mayor and Aldermen of the Municipality that this initial resolution shall take effect from and after its adoption, the welfare of the Municipality requiring it.

 This Resolution is adopted and approved as of the 12th day of February, 2024.
